Nissan, Ghosn, Kelly indicted over under-reported pay
Ghosn and Kelly rearrested, will remain in custody until December 30
Prosecutors in Tokyo have indicted Carlos Ghosn, Greg Kelly and Nissan for under-reporting Ghosn's pay in official filings.
According to NHK and other Japanese news outlets, prosecutors allege Ghosn's compensation package was understated by up to ¥5 billion ($60 million) over the five-year period ending in the 2014 Japanese financial year.
The Nikkei reports both Ghosn and Kelly were rearrested after their initial release, as they're suspected of understating the former CEO's pay by about ¥4 billion ($48 million) in the three years up to March 2018. Authorities able to keep both men under lock and key for another 20 days because of their rearrest.
Ghosn and Kelly have been held in a detention centre in Tokyo since November 19. Nissan has also accused the pair of inappropriate use of corporate investment funds, and misusing company expenses.
Later reports in the Japanese media claimed Ghosn used Nissan money to purchase luxury homes in Paris, Amsterdam, Beirut and Rio de Janeiro for his own personal use.
Nissan has confirmed to Reuters it is seeking to block Ghosn's representatives from accessing the apartment in Rio, fearing evidence may be removed or tampered with.
In a statement, Nissan confirmed Ghosn and Kelly had been indicted, as well as admitting it too, as a legal entity, had been indicted: "Nissan takes this situation extremely seriously.
"Making false disclosures in annual securities reports greatly harms the integrity of Nissan’s public disclosures in the securities markets, and the company expresses its deepest regret.
"Nissan will continue its efforts to strengthen its governance and compliance, including making accurate disclosures of corporate information."
