Caradvice.com.au Loyalty Program Terms and Conditions
In participating in the Loyalty Program, you agree to be bound by these terms and conditions (Terms). These Terms apply in addition to our General Conditions. However, where there is inconsistency between the General Conditions and these Terms, these Terms will prevail.
In these Terms:
General Conditions means the General Conditions of Use of the caradvice.com.au website, which are available on the Site.
Loyalty Program means the program through which Members of the Site may earn Loyalty Points through the proper use of the Site, and redeem such Loyalty Points for Gifts or Prizes in accordance with these Terms.
Loyalty Points means points earned by Members through the proper use of the Site.
Gifts means any gifts which We may give to a Member as a result of that Member earning and redeeming Loyalty Points or otherwise.
Member means a person who is accepted as a member of the site under the General Conditions.
Prizes means any prizes or awards We may give to a Member as a result of that Member earning and redeeming Loyalty Points or otherwise.
Site means http://www.caradvice.com.au/.
We or Us means caradvice.com.au Pty Ltd ACN 116 608 158.
3. Privacy and use of Information
4. Access, Eligibility and Use
General eligibility requirements for Site membership are set out in the General Conditions. In order to be eligible for Loyalty Program membership, you must also be a permanent Australian resident who is 18 years of age or older at the time of registering.
In using the Loyalty Program, all comments and posts made on the Site must be genuine and must contribute to the utility of the Site (in each case, as determined by us in our absolute and not unreasonable discretion). We reserve the right to remove any posts or comments that in our reasonable opinion were not made genuinely and/or do not contribute to the utility of the Site. We reserve the right in our absolute discretion not to award Loyalty Points or to cancel Loyalty Points if they were awarded in respect of such comments.
Membership is open only to individuals. No family, corporate or other group membership will be granted. Membership is granted at our sole discretion and we reserve the right to refuse any application for membership.
Members are limited to one Member account per person. Membership rights are personal and are not transferable.
A Member may not enter into an arrangement with another Member or Members (whether formal or informal) for the purposes of increasing Loyalty Points or obtaining Prizes or Gifts.
We reserve the right, at any time, to cancel, suspend, or re-instate any Member’s membership. If we exercise this right, any Loyalty Points earned by the relevant Member will be forfeited without compensation.
6. Loyalty Points
Loyalty Points are valid for a period of 12 months from the date earned. If not redeemed within 12 months, Loyalty Points will expire and be surrendered without compensation to the Member. We will not re-credit any Loyalty Points to Members once they have expired.
Loyalty Points can only be redeemed for the relevant Prizes and Gifts available at any time and cannot be converted into or exchanged for cash, or otherwise transferred or dealt with in any way.
We reserve the right to cancel any Loyalty Points received by a Member in error or in breach of these Terms.
7. Prizes and Gifts
The Prizes and Gifts available to Members are subject to change at any time. Advertised Prizes and Gifts may from time to time not be available and we reserve the right to replace such Prizes and Gifts with other Prizes and Gifts at our sole discretion. We have no liability to Members if an advertised Prize or Gift is or becomes unavailable. In accordance with Competition and Consumer Act 2010 – Schedule 2, we reserve the right to modify the Terms and Conditions without prior notification or cancel/terminate/modify/suspend/alter the programme at any time (including the rewards), you will still need to use all reasonable efforts to communicate any significant change to members of the programme.
8. Site behaviour
Members’ use of the Loyalty Program is subject to strict rules of behaviour. In addition to the conduct terms in the General Conditions, Members are not permitted to use indecent language on the Site, bully or attack another Member or any person, or make any hostile, abusive, aggressive, derogatory, racist, sexist, or other discriminatory comments, posts or statements. Members are not permitted to use the Loyalty Program or the Site to advertise their own products or services.
We reserve the right to cancel Loyalty Points, refuse to honour Prizes and Gifts, and/or suspend or terminate membership in the event that a Member contravenes the Site behaviour rules in these Terms or in the General Conditions.
9. Changes to Loyalty Program and Terms
We reserve the right at any time to make any changes to the Loyalty Program, the Site, the Prizes and Gifts, these Terms, the ways in which Loyalty Points are earned, redeemed, and expire, the eligibility criteria for membership, or to introduce a membership fee or similar.
We may terminate or discontinue the Loyalty Program and cancel all accumulated Loyalty Points and the right to receive Prizes and Gifts at any time without compensation to Members.
